Members play it at four levels, with a new set every time. A few from this module:
Question 1, locked
A founder names the company after exactly what it sells, so a stranger reading an invoice knows the business instantly. What does that name go on charging for?
- It is barred from registration for ever, exactly as a generic term is.
- It cannot stop a competitor describing themselves accurately, and it fences in what the company can sell later.
- It costs the most to teach, because nobody reading it can tell what the company does.
- It stops being protectable the moment the company becomes well known.
Question 2, locked
A drinks brand registers its mark in class 32, then starts selling branded caps and running a subscription. Where does it stand on the new lines?
- It has no protection over the caps or the subscription, because a mark is registered for particular goods and services.
- It is covered, because registration protects the name itself wherever the company trades.
- It is covered at home and needs a fresh filing only when it starts exporting.
- Its class 32 registration is now vulnerable, because using the mark on other goods breaks the original filing.
Question 3, locked
A team stops generating at thirty candidates because thirty feels like plenty. What goes wrong with that number?
- Thirty names take longer to screen than two hundred, since each one needs a full search.
- The first thirty are the strongest, and quality drops away sharply after that.
- Most candidates die to trademark or availability, so the team presents whatever survived rather than whatever was best.
- A short list reads as an unserious project when it reaches the client.
