Checking the licence before commercial use

Lesson 8 of 10 in Best practices for AI video.

Checked against the makers' documentation on 25 September 2026.

Lesson

Ownership is rarely the catch. Google's Gemini API terms say Google 'won't claim ownership' of generated content and that you are responsible for how you and anyone you share it with use it, Runway's terms claim no ownership and do not restrict commercial use, and Higgsfield says the same and lets you sublicense your rights to clients. The catch is the plan. Luma assigns ownership to you but allows commercial use only for outputs made during an active paid subscription that permits it, and Kling forbids commercial use without written permission unless you are a paying member, and makes non-members label output with its brand.

Before a clip goes into paid work: for a hosted tool, check the plan was paid when it was made, that plan's commercial terms, any credit owed and indemnity; for open weights, check the licence file, the revenue line, the territory and the disclosure duty; then music and voice, signed releases for people, and dated copies of every term.
An ink drawing of a ring of old keys on a hook beside four coloured doors; three have keys in their locks and the yellow one has a padlock no key fits.
Each plan's key opens some doors and not others.
