Copyright in a generated image

Lesson 3 of 11 in Rights, ethics and the argument.

Application Process for Registration of Works with Artificial Intelligence-Generated Content · U.S. Copyright Office
Lesson

The position taken by the United States Copyright Office is that copyright protects human authorship, and that material generated purely by a machine from a prompt is not protected, while a work containing enough human contribution may be, in respect of that contribution.

Split in two. On the left, a print lies alone on a park bench and a passer-by picks it up. On the right, a similar print sits on a studio table surrounded by marked-up proofs, cut-out alternatives and a notebook of decisions.
Left alone on a bench, anyone can take it. The record of choices on the right is what counts.
